It's through contempt of court, I believe. We have a case right now where the state court is considering not carrying out the federal court's order, and if that happens, we'll go back to the federal judge with it and I think one of the options would be to request that they find the state court in contempt.

My guess is that since all elected officials swear an oath to uphold the Constitution and since it is a living document, you'd still be forced to uphold it when it changes.

The President, could, and in fact has, ordered in American troops to enforce judicial decisions.

Also, couldn't any attorney who ignored the what the Supreme Court said be subject to disbarment? Seems like it would hard to be a state attorney general if you lost your law license.

This came up in Alabama a few years ago with the Ten Commandments. You can look and see how that turned out. It's Justice Roy Moore, I believe, of the Alabama Supreme Court.

Love the lead-in to the Wikipedia article on him ... "Roy Stewart Moore (born February 11, 1947) is a religious activist disguised as an American judge, Republican politician, and the current Chief Justice of the Alabama Supreme Court."

Wasn't the last time the president send in troops to enforce a Supreme Count decision back in the 50s/60s to enforce school integration and/or voting decisions? Honestly, I could be wrong, my knowledge of such things is limited. I'd be interested to hear if it happened since then.

But back to the point, I don't think Obama is sending the National Guard to make sure the county clerks in Texas are issuing marriage licenses equally. Could he sign an executive order federalizing marriage licenses in Texas? Or maybe get Congress to withhold economic benefits to the state (though I don't see that happening). Probably someone who is denied a license goes to court and the AG is given the choice to comply or face contempt. In a blue state, the AG would probably face recall, but it would be interesting to see what happens in Texas.

Maybe this would be the thing that could fire up the Texas Secession movement once and for all. :)

If they want to go, let them. They just better not come crying to us after the next natural disaster.

Obama has been ignoring the law when it comes to securing our borders. Why shouldn't state governors have the same powers ?

Absolutely right, T. I cried when Obama tore down that Mexican wall that our Republican forefathers built.

Not one state in the union prohibits a man from receiving a marriage license after divorcing his first wife. I have never heard any movement what so ever to stop people from divorcing and marrying over and over.

    That's proof.
