    Even if that were true, and it's not, that doesn't mean that gun ownership is illegal or, more importantly, was illegal at the founding. It wasn't.

    Is it? That would be a pretty futile argument, since, indeed, owning a firearm is a Constitutional right.

    Why don't you just cut your losses and concede that it is unlikely that it was "illegal" to own a gun and the founding unless you were part of a militia?

    And also cut your losses by conceding that you may have misinterpreted the Toobin article?
