So you're in favor of the Court restricting rights, like in most of the cases Tony listed?

Aren't you in favor of them restricting gun rights?

You stay out of this, DW. I've heard it from someone who knows -- someone smart, I might add -- that you're dumb.

Certainly, because others can be harmed by those guns.

Just like the Court has ruled the First Amendment isn't absolute, why can't the Second one also not be absolute?

Good gosh it's so easy to get Baron all twisted up in his logic.

Davis' mom was county clerk before her, and her son is currently a deputy:

Kim Davis, 49, would have known that when she was narrowly voted into office last November. Her mother had been county clerk for nearly 40 years before her, and for 26 of them Davis had worked under her as deputy. She wasn’t looking to shake things up, she told the Morehead News at the time. She just wanted to do a good job.

The defiant Kim Davis, the Ky. clerk who refuses to issue gay marriage licenses

(Incredibly, this article, linked in the Times article doesn't mention this fact: County clerk’s race more contested than usual)

There's no good reason for these jobs to be elected positions. They're part of a jobs program, controlled by local party officials for generations.

And how am I supposedly twisted in my logic?

When the Court takes a case, one of the issues they may have to figure out is balancing the rights of one against the other.

I have the right to free speech. That doesn't mean I can shout "fire" in a crowded theater unless there really is one. Why? Because the rest of the people in the theater have the right not to be frightened by a false statement. The other people benefit from not having a false alarm.

Citizens United says that one may have more free speech if they have more money. That means those with less money have less influence. More people are being harmed by that decision than are benefitting. If there was a campaign finance law, the rich donor would still have free speech, they just wouldn't be able to have more of it than the others.

Or even the right to marriage.

Back when I briefly covered local politics, you just voted for the "slate," which was made up of candidates for Mayor, City Council, and Clerk. So, a vote for one party was a vote for all of its candidates, meaning none had to campaign individually.

I'm guessing it's not the same in Kentucky?

    Which Amendment is that in?

Davis is clerk of piss poor Rowan county:

The median income for a household in the county was $33,081
. Males had a median income of $26,777 versus $20,104 for females. The per capita income for the county was $13,888. About 15.90% of families and 21.30% of the population were below the poverty line, including 20.80% of those under age 18 and 16.20% of those age 65 or over.

    What's her salary:

Davis, a Democrat, was elected to a four-year term last November. She cannot be removed from her roughly $80,000-a-year post unless the General Assembly impeaches her.

Judge orders Rowan clerk to appear in court Thursday after she again denies marriage licenses

This is a $30,000 a year job, that someone should be hired for. No wonder she's not willing to quit.
