    I think the thing I find funniest here is McConnell and Cruz are trying to sell the public on the idea that Obama shouldn't appoint Scalia's successor BUT if Obama himself came on television and said "I will hold off on appointing a Supreme Court nominee and will leave it to the next president," both would trash his decision and shit on him for not doing his job.

    This reminds me of a Sally Field TV drama about the Supreme Court, where the evil conservative judges are having a conversation about abortion:

    -"I also don't like abortion, but do you really think the Constitution prohibits it?"
    -"It does if five of us say it does."

    For a minute, Abbot was sounding like he understood, getting the amendment point down perfectly. Practically noting that under a modern, living constitution model we wouldn't have needed those or just about any amendments.

    Same thing with gay marriage etc. Scalia must have said a million times; whether he thinks it's a good or bad idea is of no consequence. He's not a legislator. All he knew was that the Constitution is silent on the subject.
