    Tough shit. You'd think the acolytes of the great legal thinker would be confident that the ringing clarity of his opinions would endure and render all the short-term niggling irrelevant.
    But rather, they seem awful touchy about it.

    Good for Toobin. Scalia was one of the least professionally graceful and civil personalities in law over the past 25 years. He was a bully and petulant when things didn't gohis way. His legal view was simplistic and he confused people, who are generally stupid, that a well written sentence means it's substantival

    He was in your face about religion but had zero understanding of the meaning of Christ's teachings. He was uncharitable fiscally and emotionally and ill suited to judge others as he believed he was infallible.

    He was free to say that, as McConnell is. And Bush would have nominated someone. And the Dems were free to reject the nomination (none occurred) and face the political consequences.

    Nobody is doing anything wrong here. This is only happening because the GOP doesn't want to be seen dismissing anyone and looking more obstructionist.

    If Scalia is one of the three worst Supreme Court justices of all time -- and I'm not saying he isn't -- what does that make the three other guys who sided with him virtually 100 percent of the time?
