I'm pretty sure McConnell can't sell that to the leaders of the Party. Ha nitty, Rush, Breitbart and Trump don't care. It's a zero sum game to them.. Obama nominates Jesus, and they are pissed that another Jew is on the court

Toobin went full Dick Whitman a few minutes ago, too, by posting a Srinivasan story he wrote a few years ago, headlined, "Justice in Waiting," and adding, "Just sayin'."

Why do you keep bringing Trump into this? Trump and his voters could give a fuck less about the Supreme Court. That's not their ballgame. That's the ballgame they are actually battling against. He's not an ideologue. When he tries to be, it's to comical effect.

The GOP pretty much has to confirm him, right? He's better for them than anyone HRC would nominate. They can easily (and correctly) say that their stand forced Obama to nominate a centrist.

Without looking, I'm guessing he's demonstrably pro-choice. If true, they have to fight him.

Because if Trump were to attempt to demonstrate his power to the Republicans in Congress by stating publicly that Obama's nominee is yuuuuugggge and the best Evah, Confgress would have no choice but to accede to his wishes or they will be inundated by righteous protests

It does seem like a missed opportunity to increase the diversity of the court, and not in a United Colors of Benetton way*. I'd like to see a non-Ivy nominee with state court experience (or political office, or public defender, or something else out of the ordinary). We don't need any more Harvard-educated appellate court judges.

*Although Scalia himself had remarked that SCOTUS did not represent the American people today or historically because they were all either Catholic or Jewish. Dude kinda had a point.
