As a big FU to the baggers who kept his appointment hanging for a year simply to stick it to Obungo: essentially telling them, "look motherfuckers, you could have had ME, a reasonably nondescript centrist, but instead you had to throw your little pissy fit against Obama and you ended up with Malik Jamal Rahman, 36 year old law professor and active triathlete from NYU Law School, who will be on the bench making rulings when your great grandchildren graduate from college in 2060. How you like them apples?"

Alternately, HRC could resubmit his nomination and demand an immediate, day one, up-down voice vote on his confirmation.

Then at the noontime swearing-in ceremony, Garland shows up wearing a Che Guevara tee shirt, John Lennon granny glasses, sporting a Black Panthers beret, and belts out a Karaoke version of Patti Smith's "People Have The Power" as his acceptance speech.

 

Interesting question. I don't know the protocol but I would think a nominee on whom the Senate has refused to act might withdraw, regardless of which party wins, to give the new president the ability to make her own choice.

 

There's a lot of disagreement as to what happens if Garland's nomination is still hanging in limbo when the new POTUS arrives.
Some say the nomination simply carries over. Others say the nomination expires with the change of administration (a very dangerous precedent if true).

An interesting hypothetical: what happens if the Dems take the Senate but Trump wins the WH?

(Realistically this is a pretty far fetched scenario.)

In that case you'd see some frantic action between Jan. 3, when the new Dem Senate would be sworn in, and Jan. 20, when President Dumpster Fire would take control at the WH.

Probably every single Obungo judicial appointment which has been butt-plugged by the teabags would be rammed through at hyper-warp speed to get them in the saddle before Fucko arrives.

Ginsburg wouldn't resign because that would mean Trump would name her successor. Being tainted by politics, Ginsburg wouldn't want that to happen. Her orders would be to keep her on life support until another Democrat won the White House.
