No, I'm really not, but keep telling yourself that. If touches like what she did with her left hand before the slap are actually battery, the courts would never deal with anything else.

Nothing worth responding to? More bullshit. You just answered what I questioned in the very first response. I guess you finally got desperate enough to try to float this extra bit of bullshit.

He lunged at her (after the shove) and she put her hand out. Again, I get what you are saying with the shove and the slap, but no way in hell would you consider that other touch battery if you weren't invested in calling it such for the sake if this discussion.

I understand it just fine. I believe his interpretation in this case is absolute bullshit.

Also, was she charged with even one count of battery, much less three?

Have you ever heard of prosecutorial discretion?

Is discretion a denotation, a connotation or a detonation?

OOP ... come on, man. I don't know EXACTLY where @franticscribe plies his trade, but I know he's a bona fide prosecutor; he makes his living knowing exactly what this stuff means.

Were you in this pissing match with any number of other board members, there'd be at least a chance that you were right. But when your opposition's @franticscribe? No friggin' way ...

Did you come to this conclusion from your experience litigating?

Yup. Just making the point that in this case, she was not charged, so it isn't as clear as frantic is trying to make it out to be in his post.

I've made this point many times on this board and I stand by it here. Expertise is one thing, but honesty is another. She was not charged, so we are talking about the law and subjective interpretation. I believe his interpretation of that touch at this point is driven by supporting his own side of the argument, not expertise.

By your way of thinking, YF should defer to about 80 percent of this board on matters related to journalism. I do hope you are going to take that up with him soon. Thanks.
