    I'm not an attorney, just a former paralegal. That should spell out my lack of legal expertise.

    (Apologies if my styling is incorrect. It's been a while.)
    Is Mixon within his legal rights to play "Hulk Smash!" if Little Blonde Girl gets physical? If not, at what point does provocation become a mitigating circumstance? The only place I can find in the OCA that directly addresses provocation is in the section about first degree manslaughter, so it's not really helpful. So does it come down to prosecutorial discretion as Dick Whitman suggested? Am I even asking the right questions here?

    You claimed she committed battery three times that night. I believe that is a misrepresentation of what happened on the tape. I can certainly see claiming that the shove and the slap were battery, but the other touch? Bullshit. At the very least, it is a matter of interpretation, not as cut and dried as you and Dickie have made it out to be in this discussion.

    And in this case wouldn't the interpretation that mattered be that of, I don't know, maybe the kind of person who has the power to decide whether to prosecute people?

    Given that he is doing so in defense of an argument he already made and that calls his honesty on the subject into question, no, not so much.

    franticscribe claimed that she grabbed him with her left hand before slapping him with her right. Look at the video. She has her left hand on him, but that is not the same as grabbing. He also left out that Mixon lunged at her as if he was going to hit her after the shove, but before any other touching.

    Also, somebody with that exact power chose not to file any charges against her.
