I don't think there is any reason to believe (off of one skimmed article, not having read the decisions) that he wouldn't have voted with the other justices had he been on the SC. Even if he would have, there have been many 8-1 decisions. Interesting nonetheless.

 

Exactly what I've been trying to say. There will be plenty of legitimate battles to fight with this administration and a GOP congress. This isn't one of them.

 

Nothing can stop that now.

The only question is whether they're just going to bend over and let it happen, or at least kick and scream about it.

 

Gorsuch is probably a fine, qualified choice and one Dems, under normal circumstances, would be able to live with. But you could say the same about Garland and the GOP. Garland didn't even get the kind hearing that Gorsuch is getting now. Did he even get a meeting with a Republican senator?

What bothers me most, though, is that the Republicans almost pretend that the Garland thing didn't happen, that even the idea of not confirming Gorsuch would be an unprecedented political move. McConnell basically said as much. It's unbelievable the alternative universe they live in.

So, yes, the Dems could take the high road and, after a strong grilling of the nominee, confirm him. But I don't blame them for noticing the elephant in the room, which is that it's a stolen seat.

Oh how I wish Obama would have said the Senate's choice of not advising and consenting was indeed its advice and consent and just placed Garland on the Court, then let the Constitutional chips fall where they may.

 

But then Obama would have looked like an angry black man and the Republicans would have criticized him.

OK, so Devin Nunes, Chairman House Select Committee on Intelligence, just told reporters there may have been "incidental collection" of Trump campaign personnel conversations, presumably with Russians. Nunes did not tell his Democratic ranking member Adam Schiff about this, a breach of protocol. He is going right over to the White House to brief the administration on the investigation of itself. Now the FBI is in charge of the counterintelligence investigation and telling Nunes this stuff and not Schiff is a breach of protocol for them, too. Either elements of the NYC FBI office are undercutting the investigation of their own agency by leaks, or Nunes was given the information as a security trap. If the latter, he's gonna be in a world of hurt.

 

Interestingly, he said the incidental collection did not involve Russia.

It all seems very strange that evidence of wiretapping the then GOP nominee comes out two days after the FBI and NSA testify there's no evidence he was wiretapped.

That's just it. Incidental to what exactly? Either Nunes has spilled the beans on ANOTHER investigation, he's flat out lying (doubtful, doesn't seem the type to carry that off) or he's being set up for a hard fall.
