    No. It's apples and oranges. As Commander in Chief, President has responsibilities under the military code of justice which don't apply to civilian trials.

    I know we have a few lawyers around here. Anyone know military law enough to say if the judge had any other option? Seems like there would be some discretion between life in prison and time served.

    It will muddle the prosecution if nothing else. The defense will certainly argue due process violations.

    The ruling was made a United States Army Colonel. I am sure that officer knew exactly what he was doing. Agree of disagree, it was by a uniformed soldier in the Unites States Armed Forces. He is in a better position to judge Bergdahl than the draft dodging C-in-C.

    There is no way the NYC suspect gets the death penalty after Trump ran his mouth. If I remember correctly, Nixon called out Manson and had to back off because of a call for a mistrial.

    No, damn it, no! The court is exercising its discretion to make it clear that the military justice system, while not independent like the criminal justice system, goes out of its way to ensure justice for the accused. The tangerine buffoon’s inability to shut his fucking pie hole — both as a candidate and as President — put the whole military justice system in an impossible position. Better Bergdahl get off light than every military prosecution be tainted.

    It makes it very clear that higher-ups don’t get to put their thumbs on the scales.
