It's an enormously meaningful difference that Franken's seat is safe and both Moore and Trump would have surrendered the open seat to a Democrat. If you mean morally, I agree with you. But politicians' ethics are situational.

Oops. Sorry. I should have been more observant of our Constitutional principles in the Age of Trump.

 

If Moore is expelled or forced to resign, then his seat is not being surrendered to a Democrat. It's an easy slam-dunk Republican win the moment they nominate someone who isn't a batshit insane child molester.

 

It's easier to justify in a Franken case. The People didn't know about this when he was elected. In Trump and Moore's cases, the People knew - and elected him anyway. Who is Congress to override the will of the People?

 

I'm sure not implementing those rules will be a disaster for all those consumers who've never been protected by them.
