Penn State scorn versus Michigan State scorn

    The judge declined to release the entire letter written by Nassar. Though I don't know how that works, if I'm media covering this trial, that's something I'd want.

    These women are incredibly thoughtful and well spoken.

    Then I hear the Tom Izzos, and the Fergusons speak.

    We won one recently, on a case at my old firm, but there were really unique mitigating factors. The case was sent back to state court from federal court on ineffective assistance of counsel because his attorney had misadvised him on the sentence he faced if he went to trial. She went off about how the trial attorneys were not ineffective and that my client had lied to his attorneys - essentially saying she disagreed with the federal district court's decision on both the facts and the law, when she was bound by the federal court decision. But even in our case, it was really tough to get around the trial judge's sentencing discretion. I was mildly surprised that we won. (The State is planning to seek cert with the state Supreme Court, so it's still not over.)

    My favorite recent sports one was Ron Rivera having the team yell "Mr. Richardson!" on 3, just after Richardson had gotten embroiled in #MeToo and said he was going to sell the team.

    What a bunch of idiots.

    Fuck them. No remorse after the fact, no buck stops here, but plenty of This Nassar Thing, and look at the donations and signage at the arena. FUCK THEM.

    You can't disband an entire state university, send every student home and fire every staff member from athletics to anthropology. Even if a whole lot of people want to.

    Exactly. It typically takes a pretty odd set of facts to succeed.

    How it works is you make a request to the judge to unseal it. There is a pretty strong legal argument for releasing supporting materials to a sentencing decision (mental health and medical records excepted). Judge denies the request, you get a lawyer to file a motion to unseal and go from there.

    Around here we have seen the media lawyers create coalitions of competing outlets to pitch in and go after docs like this.
