    If no crimes have been committed, why would an attorney need to plead the fifth in a civil case?

    I'm no fan of Team Trump, but I despise this argument.

    I've advised clients to plead the Fifth in civil cases in which I did not believe they had committed crimes.

    I'm no lawyer, but my family and I have received a couple lawsuit settlements for car accidents, and they were tax-free.

    Not sure if the same thing applies here, though.

    If you don't spell out exactly how much of the consideration is for "damages" and how much is for "keeping your mouth shut" -- the latter's the part that's taxable -- a tax court will be perfectly happy to spell it out for you.

    Anybody can plead the Fifth and it should be regarded without prejudice. I just read a tweetstorm from that lawyer Popehat who said Cohen must have done so reluctantly since it will very adversely affect his side in the Daniels civil suit.
