No they aren't, until they are processed, put on an ankle bracelet, check in with ICE, have their cases adjudicated, and pay a fine. It could take weeks.

Also, illegal entry in this case is a petty misdemeanor, the lowest violation on federal law, like a traffic ticket. When's the last time someone had their children taken away because of a traffic ticket?

Finally, starting in 2005 the US stepped up border enforcement under Operation Streamline. It resulted in no reduction in illegal entry, cost billions to enforce, and created mountains of paperwork for border staff, and was dropped.

There's no easy solution, since immigrants have long seen spending a few days in stir as more than worth the price of entry. With no more severe penalty available, might as well go full Gestapo and cage the children, right?
