Perhaps Trump is just planning to use this as a gauge to measure how well the GOP has been able to stack the courts.

 

I'm not a lawyer, but this is correct. Presumably would be fast-tracked to the Supreme Court (fast being a very relative term). It's black letter constitutional law, which means exactly nothing to the current Court. But the Court will face the counter-pressure of acceding to a loss of its own authority to advance its political goals. We can see from Congress that pressure is kind of weak.

 

Oh my God, that's amazing. It's like a scene that Ricky Gervais cut from The Office for being too uncomfortable.

I'm ... 95% ... sure that even the most conservative court wouldn't let the President executive order away explicit Constitutional amendments. They've done a pretty good job of stacking the courts with power fetishists who will give the President wide latitude, but not that much. If they did, that's real Civil War II shit, where the coastal states are forced to declare the government illegitimate and then all shit breaks loose.

I don't think he's actually going to try it. He parrots whatever he was told by whoever he talked to most recently, so I assume he was talking to his super duper racist friends and not his regular racist friends this morning. It's a trial balloon that he'd probably go through with if he didn't get too much pushback, but his regular racist friends will talk him out of it.
