    OK is a subjective thing. ... No, it isn't OK. It's a shitty thing to do. At least in my opinion.

    Secondly, hacking. ... or stealing my doctor's patient files in any way (hacking, physically taking them), are illegal acts. We have laws to deal with those kinds of things. I think most people are fully on board with those kinds of laws, and they certainly don't butt up against the Bill of Rights. Prohibiting stealing is one of the most basic tenet of the social compact and the role our government was actually set up for.

    OK but what if I didn't do the hacking? What if I just came across the fruits of someone else's hacking. Am I free to post your medical records online?

    I'd argue there might be one or two hypothetical examples in which revealing private medical records might be a matter of public safety; an act of public interest whistle-blowing.

    Other than that, no.

    Sue me for what? The freedom to disseminate information is also essential to what makes a person free, too, in an age of enlightenment way.

    I honestly don't know the law well enough to know what is and isn't criminalized with regard to that kind of thing. Our laws are messy. I know HIPAA regulates an insurance company or a doctors office with regard to how they handle medical records. I don't know all of the ins and outs of HIPAA. I know from a regulatory standpoint, it has been incredibly costly, inefficient and has lowered the quality of medical care by bogging down medical practices with what many of them say are onerous and senseless requirements that get in the way of their ability to administer care without excess cost. Regardless of that, though, I honestly don't know what laws exist with regard to, say, you turning around and randomly posting information about me on the Internet.

    I do know there would be a lot of civil recourse for me if you did it and harmed me in the process. I think that is very fair.

    Invasion of privacy. Breach of doctor/patient confidentiality.

    We put all sorts of limits on speech and freedom and on the dissemination of information.
