The statute codifies what is currently constitutionally protected. It allows legal abortions up to 24 weeks, after 24 weeks if the fetus isn’t viable or to protect the life or health of the mother. If Roe v Wade is overturned, abortions in these circumstances will still be legal in New York.

Why/how would they would still be legal?

 

Overturning Roe would only mean there is no constitutionally protected right to an abortion. It does not make abortions illegal. It does not prevent any state from statutorily allowing abortions, as some did even before Roe.
