SCOTUS doesn't have time in this term to address it, it'll be in 2021 at the earliest. By which time replacements for both RBG and Clarence may well be in place.

 

Which brings me to this nugget: Thurgood Marshall died on Jan. 24, 1993, four days after Bill Clinton was sworn in. Think about how different history would be if Justice Marshall hadn't bailed in the middle of a Republican administration.
