    Should have gone for murder one from the start. The charge can be backed off well after things calm down.

    Huge.

    The Minnesota 2nd degree murder statute is pretty particular and finely drawn, so I wasn't sure if they'd just stick with 3rd/manslaughter.

    Charging the other three with abetting murder is a very big deal.

    Those three needed to be charged for doing nothing to stop this. But if those cops are acquitted, it will be 92 all over again.

    Just presuming Murder 1 is same as in CA, very much doubt you could prove that Chauvin intended to murder Floyd PRIOR to meeting up with him. For M1, it must be premeditated, meaning you go out intending to kill (leaving house with gun in search of the victim).

    The problem with murder one is proving intent and getting a guilty plea. Sometimes that's the politically popular charge but it leads to overreach. Yes, you can treat the last 2 1/2 minutes on his neck after his last words as intent, but if the jury does not agree the guy walks. Better to get his ass into jail on a 2nd or 3rd degree case than to have another cop who killed a black man walk away free.

    On TV shows I have watched the jury can find a lesser crime. Watch the Netflix series on famous media trials. It occurs.

    A smart prosecutor does not depend on the jury to make the choices for him or to make the right choice. Charge the maximum case you can prove, then get a guilty verdict. Done.

    The problem with going murder 1 is you have to prove premeditation and intent. Knowing they can never prove premeditation, the defense could always get the case tossed and that is a worse look.

    With Drew Brees trending on Twitter, I can safely assume this means NBC won't want him now and that he'll be the Raiders quarterback in 2021.
