Gonna be an interesting test case. All those who have received the subpoenas will likely be contacted by a libertarian group that will fund their class action.
Are these people required to comply? Or are they protected by the Fifth Amendment?
Would love to hear what experts think.

It's not self incrimination, as exposure to the virus is not a crime. Have no idea what New York law is about public health, but refusal to cooperate in a state of emergency might earn a significant fine if they stay clammed, or even a contempt citation.

But if there is a law or policy forbidding large gatherings and there are penalties associated with violations, are you committing a crime by attending?

    Very possible.

And the impact on both is definitely worse than had experts said on March 15: "Wear masks, everyone.'' With states making them mandatory in public and closing only businesses that required people sitting/standing shoulder to shoulder (sporting arenas, nightclubs, bars, etc.).

Yeah imagine if we had a functioning pandemic response team in place instead of it being dismantled by the same guy who said this whole thing was a hoax. Given what happened in countries who knew what the fuck they were doing, we might still have needed to shut most everything down, but that and masks and our Covid curve looks more like Europe's than the unmitigated disaster we have now.
