    Presumably any military order given by a demonstrably batshit lame duck could be construed as "unlawful."

    In this specific case, starting WW III because president crazypants was angry seems like a good time to ignore him.

    Reminder only Congress has power to declare war.

    Reminder that the last time Congress declared war was for WW2. We’ve had a few situations since then that looked a lot like war, but apparently we’re not.

    I'm fine with what Milley did, and I was on the record here of being super critical of him following the church gassing.
    1. He made sure the U.S. military wasn't involved in a coup.
    2. He acted as a buffer between a butt hurt madman and disaster.
    3. He reassured a possibly trigger-happy adversary that despite the ramblings of a lunatic, we weren't going to launch an unprovoked strike, so they could stand down.

    When someone is shooting in your direction, it really doesn't matter if there is a declaration of war or not.

    Yeah, the typical hypothetical usage of nukes is an enemy launching them and us having 30 minutes to react.

    Not sure there's a place for Congress in such situations.
