    The State cannot appeal a verdict. Double jeopardy. Even if the judge made reversible errors in evidence. Some state’s can appeal pre-trial rulings involving constitutional rights but not verdicts.

    He's not going to be convicted. Can the state appeal if there is video evidence that the judge swayed the decision?

    Can’t appeal a not quilty Verdict either. The only verdicts I’ve heard of that were allowed to be appealed by the state are where the state could show that jurors had been bribed by the defense for a specific outcome. The rationale being there was never a trial if it was predetermined.. doesn't apply to the judge

    I'm wondering how you get a mistrial declared if the one causing it is the judge? Apparently there was a round of applause for the very first offense with this because he was a veteran.

    One way is to make a motion for mistrial. State makes enough of a stink that the judge loses his shit. State has a risk in asking for a mistrial. Retrial isn’t always guaranteed because of double jeopardy.

    Every analyst said the prosecutor fucked up big time so if there’s any mistrial it sounds like it would be on them, not the judge
