Plus, if he didn't want to get shot, he would have clipped his dirty toe nails to make sure that my client wouldn't assume he was a runaway slave.

The abject racism of the comment about the long, dirty toenails is staggering.

A defense attorney putting up what she thinks is the defense most likely to get her client off.

Let's see if it actually works. I am not going to find an attorney slinging shit staggering. That is what they should do. I will find a jury acquiting on a cold-blooded murder when that is the defense, staggering.

Late to the game. And as someone who wishes the laws worked differently so that someone who brings a gun to a protest -- even legally -- and ends up killing two people and wounding a third could be held criminally accountable in some way, the above analysis is, to be frank, bullshit. Rittenhouse was stupid and irresponsible but he did not "get an illegal gun" and he did not cross state lines with said gun and he did not go there to "shoot up a protest." And while I agree that our criminal justice system is grievously infected with racial bias, I find strawman arguments about what "would" have happened to a Black kid under similarly bizarre circumstances (we really have no way of knowing for certain) most unhelpful-- juries do tend to take their responsibilities seriously. I also find the suggestion that someone who is not culpable under the law should be convicted anyway out of some misguided sense of "equity" to be equally unhelpful and offensive. Reform the system, sure. But that quote is such a crock of shit.

Which is fine theoretically, but in the real world would result in even more black people getting shot by the police.

This is a perfectly fair take.

Defense attorneys have been essentially arguing jury nullification in every jurisdiction for 100 years. It didn’t start with Reginald Denny or OJ. African American defendants in areas where African Americans are on juries get nullification argued on their behalf every day. If not for acquittal at least for a hung jury. So no one except the media is shocked, shocked that race plays a significant part in criminal
Trials. And while it’s not as blatant as asking a jury to disregard the law and acquit, it’s pretty clear that’s what’s being done.
