    This system is broken. I'm tired of the Constitution being held up as some infallible document.

    The framers fucked up. They trusted us.

    It was written by and for a certain class of white men, well off mercantilists and farmers. And for nearly 150 years fulfilled their dream and allowed immigrants’ dreams to come true that if you worked hard enough you could over come the station of your birth and be rich, unless you were black. They were able to see past the English hatred of Catholics and Irish. The German and English dislike of Eastern and Southern European. The combined Hatred by everyone of Jews and even the Chinese. Never able to incorporate blacks into the mix. The founders started a country that was a miracle, however brief, in world history. But the stupid and ignorant who got here here 1st and 2nd and after generations still couldn’t make it, became bitter and militant and fucked it all up. The step great great great grand children of the founders never got better than white trash. And now they are trashing the everyone’s dreams.

    There's a good argument to be made that Roe itself was ruling by judicial fiat and the Court checked itself with the Dobbs ruling.

    And if the court was made up of intellectually honest and judicious Justices I could understand the argument. They are not. Roe asked when does unborn’s potential life outweigh the mother’s rights to privacy so that government has a greater interest than the mother’s. It was an imperfect opinion. The intellectually and Constitutionally appropriate opinion is that abortion is a medical procedure and can be regulated as if it were cancer treatment or by pass surgery. Congress and the State’s have no right or power to say that a certain treatment is unavailable for nonsafety reasons. But the crap that poses in Dodd is truly bad legal reasoning.

    So the Constitutionally appropriate view is that: 1) "it can be regulated"; and 2) no person or entity can regulate it. Truly, yours is a breathtaking intellect.

    Reading is fundamental. Government can regulate abortion but not ban it for nonsafety reasons. Government can say only medically approved instruments in a licensed clinic can perform them. They have no power to deny that abortion exists. Sooty if you can not understand that. Try harder. Read Roe. Go back and read Griswold especially the concurring opinions.
