    Constitution is limiting document, not a rights granting document. People can do whatever they want unless the Constitution specifically forbids the federal government and in some cases the state government from restricting or regulating it. The burden is on the government to Constitutionally justify their action not on the citizen to prove their actions are in compliance. Abortion and same sex marriage are available because the Federal government lacks the authority to regulate or restrict either.
