    Biden can, under the 14th amendment, simply announce that he will tolerate no interference with the issuance of US debt and continue business as usual, so to hell with the GOP House. And if the Supreme Court rules against him, to hell with them too. Trump and before him Clinton proved that there is no, zero, zip, nada political price to be paid for enduring an impeachment that ends with acquital.

    Sorry, but that is nonsensical. The 14th amendment has nothing to do with this.

    Congress has the power of the purse under our system of government, even when it is Kevin McCarthy as the House leader and you disagree with him. And the president doesn't unilaterally get to decide what he'll tolerate with regard to spending or debt issuance. He's not the king.

    I'm told that the bolded phrase in this snippet from the 14th ...

    "The validity of the public debt of the United States, authorized by law, ..."

    ... has been rendered moot under the "living Constitution" doctrine.

    "The validity of the public debt of the United States, authorized by law, including the (several clauses here about debts incurred in the Civil War) shall not be questioned." Is the debt ceiling an "authorization by law" or is the overall legality of public debt the "authorization by law." Opinions may differ.

    The 14th amendment was ratitified to keep states from depriving blacks rights in the wake of the civil war. The public debt clause was put in there to keep Congress from repudiating debts that had been incurred by the Union states.

    This is not a matter of opinion. It's a matter of historical fact. "Opinion" = what level of bullshit some people are willing to create to try to turn the constitution into whatever is politically expedient for them at any moment in time. That clause barred Congress from repudiating debt it had already incurred. It was not an authorizatoin for the president to incur more debt whenever he wants. That is a power vested in Congress under our system of governance.
