Pence is going to argue that he was acting in his capacity as a member of the legislative branch. He'll probably win that argument.

No. No privilege attaches to knowledge of a possible crime. US v. Nixon. US v. Brewster.

Cheney is wrong. Besides, Pence's knowledge of potential criminal activity isn't what happened on Jan. 6 in the Capitol, it's what was said to him and what he saw in events leading up to him getting to the Capitol. If the President says, "commit a crime for me as part of your legislative duties" he can't shine that on by saying it was part of his duties. That'd be a request to violate his oath of office. Sen. Graham tried to argue that he shouldn't testify to the Ga. grand jury because it was part of the speech or debate clause and the Federal court shot him down in short order.
A sentence from Supreme Court decision US v. Brewster. "The Speech or Debate Clause does not prohibit inquiry into illegal conduct simply because it has some nexus to legislative functions."

Feinstein and Grassley are going to die in each other's arms, the Senate's version of "The Notebook."

But Pence told The 1/6 committee he couldn’t do it because he was claiming executive privilege
Can’t be executive for one body and legislative for another
Plus how does his being president of the Senate shield his pre 1/6 conversations with FatFuck?
