    There has been speculation that the Lord and Savior will be indicted on charges related to Insurrection. (This speculation has calmed in the past 24 hours with reporting that such charges aren't enumerated in the letter that Smith sent to Trump's counsel.) But at any rate, this rather sobering story points out what I had wondered. While the 14th Amendment and one particular statute speak of ineligibility to serve, nothing seems to explain a mechanism. The 14th doesn't deal with provisions in Article II to any great degree. It doesn't say, for example, that Article II is amended to say the Electoral College cannot consider those candidates deemed ineligible.

    If Trump were charged and convicted under this law, he could no longer legally hold office—that much is plain. But who would enforce that outcome? Certainly, if he were convicted by next July, when the Republican National Committee will host its convention, the party could refuse to nominate him based on the language of § 2383. That seems unlikely. The alternative would be to ignore the law’s express penalty, an easier political path. Once nominated, if Trump were to legitimately win 270 Electoral College votes in November 2024, Republicans in Congress could simply insist that they all be counted on January 6, 2025.

    Additional indictments can be added in a superseding indictment . If the investigation of the new charge is not yet complete, if there are witnesses that have yet to testify, or if there are additional defendants involved in another charge and the AG does not want this revealed to them charges could be added later. It is also possible that Smith is simply charging lower level crimes that he has everything he needs to prove already, as when Al Capone went to prison for tax fraud. The witness tampering case is a big deal all by itself.
