Right, but what I'm suggesting is that the Governor, Beshear, name himself to the seat.

 

The law says the party of the ex-incumbent in the legislature puts forward a list of three names and the Governor has to pick one of them. So there's no way Beshear could appoint himself.

 

Plus he actually likes being governor and is a slight favorite for re-election.

 

Mitch has gold-plated health insurance. He should be OK.

 

I read the statute, and it looks like they covered every possible loophole.
This does create an interesting "Too Soon?" problem for media outlets if the day comes and goes without a report that he's fine.
Given the close partisan composition of the Senate, everybody's wondering these questions. The answer is short and simple: "The partisan composition of the Senate will not change if an interim replacement has to be named." But when is it appropriate to bring that up for the first time?

Kentucky governor should just slow roll naming a replacement (if he gets the chance). Heck, there was a House district in Florida that went a year and a half without representation because Desantis refused to call a special election in a safe D district.

 

He realized who would take over if Biden was actually removed from office.

He probably thought he could go from 1 to 3 in the line of succession.

 

Or they could impeach Biden and Harris as a two-fer and make McCarthy, who is third in line, president.
