Douthat seems to be saying that it can’t be an insurrection because the mob failed to kill Pence or to seize power. By that logic, the Civil War wouldn’t count, either.

 

There was a good back-on-forth on this -- Insurrection, Yes or No? -- on the Volokh Conspiracy last week.

 

At any rate, it seems silly to me that a single person — a Secretary of State for example— can decree a candidate guilty of insurrection and strike them from the ballot.

You have a standing Congressperson running for president and a network refuses to interview him. Now, of course that network can do what it wants. But it's worth asking why not when, indisputably, the counter-factual claim (provided by the writer) would have absolutely come to pass if the parties and candidate were reversed.
