    Rape isn't an odd crime, the investigation and the conduct of the police have been very odd.

    The police dealings have made him look guiltier then anything Winston has done or allegedly done.

    It isn't the crime, it is the cover-up.

    I think it's "odd" in that it depends on a lot less he-said, she-said than other crimes. Rape kits are great, when they work. But they yield a lot of false negatives, as well.

    Plus, consent is often implied, rather than explicit, when things get going. When alcohol is involved ... lots of misunderstandings.

    It's so tough to prove this kind of stuff.

    In college it is so frequent that somebody gets drunk and does something that they regret the next day that it makes it very difficult to tell if a crime took place or if it was just a drunken college hook-up.

    I have no idea what happened. I would hate to ruin the guy's career over a he said, she said situation. I would also hate to let the guy go if he did rape her.

    This seems like a pretty tough one.

    I wonder how many rapes actually follow the stereotype a lot of people think of: Violent offender pinning down a helpless, scared woman. Very few, I bet. I imagine that misconception was why there seemed to be a huge push a few years ago to start taking "date rape" way more seriously, and why there is a lot of stress made on the fact that most rapes are perpetrated by acquiantances.

    My instinct, and I don't know what kind of information there actually is on this, is that a lot of times the man THINKS he's trying to get the woman to change her mind.

    In college, one of my best friends was fooling around with a girl we all knew, also a friend. She says, "No." He rolls over to sleep. That's the end of it, as far as he's concerned.

    A few seconds later, she says, "Don't you know that sometimes 'no' means 'yes'!?"

    Yeah, that was the end of that for him.

    I'm guessing the percentage of people in college who had sex with someone and regretted it immediately is very high, for men and women.

    Again, no idea what happened here was, but proving date rape is very, very difficult.

    Seems like a hard one to prove as well. Maybe it comes down to "he said, she said". I'm certainly not in favor of throwing the guy in jail, but it doesn't exactly enhance his reputation, either.

    I'm not assuming Winston is innocent, but I'm also not assuming this woman might not be looking for a payday.

    It's terrible to even think like that, but after Duke Lacrosse, among other instances, I don't blame anyone for looking at this with a very cynical view.

    Hell, we've had Presidents with this type of problem. Just not enough of a big deal to
    exclude Winston from consideration. I bet some of the Heisman voters who will
    not cast a vote for Winston even voted for that President - twice.

    Does Winston have any money?
    She made the claim before the season started and he became a sensation. It hardly strikes me as a likely scenario of someone looking for a payday...
