Will Ofc. Wilson be indicted in Michael Brown's Death

When's the decision going to be made, and what will it be?

We're starting to get some stories coming out of the Grand Jury proceedings, including this one:

 

No one cares anymore. We've moved on to the Ebola story.

 

At this point, I suspect they're not going to indict, and the prosecutor and the cops are trying to delay it further so they come up with an action plan to prevent more problems in public reaction. If the guy who spoke to the newspaper is, in fact, an eyewitness, the defense will put him on the stand and his testimony could be construed by at least one juror to constitute reasonable doubt.

The officials briefed on the case said the forensic evidence gathered in the car lent credence to Officer Wilson’s version of events. According to his account, he was trying to leave his vehicle when Mr. Brown pushed him back in. Once inside the S.U.V., the two began to fight, Officer Wilson told investigators, and he removed his gun from the holster on his right hip.

Hey, the FBI knows a good shooting.

They've had 150 straight justifiable shootings going back to 1993.

 

from 1993 to early 2011, F.B.I. agents fatally shot about 70 “subjects” and wounded about 80 others — and every one of those episodes was deemed justified, according to interviews and internal F.B.I. records obtained by The New York Times through a Freedom of Information Act lawsuit.

The bar for a "justified" shooting is usually the officer believing his or others lives are in danger. That's why it's called justified and not necessary.

 

As Johnnie Cochran would say, "If you grab for the copper's gun in his car, claiming you're innocent will not go far."

 

The only chance of indictment is if the grand jury decides the last few shots -- presumably the kill shots -- occurred when Wilson was no longer in danger and Brown was no longer a threat.
