At this moment, the only thing holding all this back is the legal doctrine the president or former president cannot be indicted for any crime, ever, a legal principle first promoted by the Office of Legal Counsel under the AG of Richard Nixon, a president then under imminent threat of indictment, and later supported by the AG of Bill Clinton, also a president under imminent threat of criminal charges.

Pretty much at any other moment in the history of the republic, the concept that any president should be considered invulnerable to criminal charges for the rest of their lives would have been considered preposterous at a minimum and more likely an active affront to the constitution itself.

 

They are not going to even mention the death penalty for Trump unless they know something that has not leaked, but War Plans are near the top of the sensitive document list. Disclosing war plans to someone unauthorized is a very serious charge, and if they were disclosed to someone with foreign connections that goes up to a boil.

In fact we can't even say it. We have to say "he cannot be exonerated" when in reality we'd have to say, "he's guilty as shit, he committed crimes in full public view.
