Oh well I am sure it's a lucid and well thought-out legal motion based strictly on entirely valid legal principles

But on the other hand, it's probably entirely safe to assume:

It doesn't look good on its face, but I suspect this is mostly about muddying the waters. The AJC noted that the motion is thin on its sourcing of the claims.

This is the kind of tactic the defense usually only takes only when it's running out of options.
