Deadspin posts the Favre pics. Ugh.

    Isn't it your resonsibility to prove the papers have ignored/all but ignored the story given you made the claim?

    Why should someone else have to produce links to support/prove your assertion?

    Not to speak for Machine Head but I'll bet he/she is saying that if you have time to post here you have time to click on the Strib/PP pages.

    Thanks, Double Down. Glad I wasn't imagining things.

    I just went to the Pioneer Press website. I see three stories today, plus some blog items. Bully for them for trying to catch up. I don't have the desire to go back and see how much there was prior to today. According to the link Double Down provided, I probably won't find much.

    Quick primer on sexual harassment law. Employers can be on the hook for quid-pro-quo either as a term of continued employment ("fuck me or be fired"), as a basis for a promotion/demotion ("fuck me if you want the manager job") or because it is so pervasive that it affects a term, condition or privilege of employment (hostile work environment). HSW is very hard to prevail on as a plaintiff because it typically requires a lot of harassment over a relatively short period of time. The idea behind it is that employees should not have to survive a gauntlet of harassment to get through their day, but you have to live through isolated incidents.

    I haven't seen any facts to indicate that Sterger was given the idea, even implicitly, that her continued employment was dependent on possibly putting out. To advance a HSW claim in federal court, Sterger would need to show (1) she suffered discrimination based on her sex; (2) the harassment was severe or pervasive; (3) it affected the terms, conditions or privileges of employment; (4) it was objectively unreasonable; (5) management knew or should have known. What 3 and 4 really get at is that the victim needs to subjectively see the harassment as bad and it needs to be objectively bad.

    If you tell a very off-color joke at work, that alone is not going to be a viable HSW claim. But good employers still freak out because A) They don't know if this is the first off-color joke you told in that person's presence or the 17th in 3 days and B) If they do get sued, they want to be able to say that they dealt with it as soon as they knew about it to deal with the 5th element of the HSW claim.

    To me, Sterger would have a decent claim. Not a slam dunk, but she wouldn't get laughed out of court. The Second Circuit Court of Appeals, which covers New York, has been open to claims that certain independent contractors are employees for purposes of federal sexual harassment law. She can assert that she was repeatedly propositioned by a fellow employee over a short period of time, culminating in receiving photos of his penis and that the progression was objectively unacceptable. And she can claim that management should have known since they were the ones who gave Brett her phone number. Under federal law, she cannot sue Favre directly, but she may be able to under state sexual harassment law.

    However, Sterger cannot sue the Jets today. In order to sue for HSW sexual harassment under federal law, you need to report your claim to the EEOC within either 180 or 300 days of the harassment, depending on certain factors. Assuming Sterger wasn't harassed after Favre left the Jets, more than 300 days have passed and her claim would be dismissed from federal court.

    Childress also was asked if the reports circulating about Favre have proven to be a distraction. The NFL is reviewing allegations by the website Deadspin.com that Favre sent inappropriate messages and photos via cell phone to former Jets sideline reporter Jenn Sterger when he played for that team in 2008.

    The website reported Friday that a woman who worked for the Jets as a massage therapist is alleging she and another therpapist got suggestive text messages from Favre.

    "It's not a distraction to us at all," Childress said, pointing out the team talks about everything. "We just don't let it be. We address it, we talk about it and we're done with it. I haven't heard anything. I don't know anything about [the NFL investigation]."

    Asked about how he deals with this type of situation, given that it's not exactly the norm, Childress responded: "I don't know how to categorize that. We just talk about what's out there and look it right in the eye. Deal with it to the extent we can. It doesn't affect anybody else in this locker room except Brett Favre."

    Did you read the last part of what DD linked?

    For two months, all readers and competitors had to go on was an editor’s second-hand account. On Thursday, after paying a third-party source “more than we ever have,” Daulerio published voicemails and a crotch shot. While the voicemails sounded like Favre, even Daulerio couldn't conclusively tie them to the quarterback.

    For me, the initial allegations weren't enough to retransmit. It’s not that I’m above Deadspin’s tabloid allure; I’m addicted to Drew Magary’s operatically profane NFL “Jamboroo,” and I enjoy idiocy and eye candy enough to watch a four full minutes of this Florida Gator football braggart.

    But when it comes to Favre, my bottom line is: even potentially skeevy celebrities deserve fairness. Until the voicemails emerged, there wasn’t enough for me to add my professional voice to Deadspin’s megaphone.

    Was it the lead item in the notes? Where was the placement of the story in Friday's paper? How much original reporting has either paper done on this subject instead of just following what others have reported? Who knew what and when? How many of them heard rumors about this long ago and chose to not pursue it? How much play has this been given by the two papers' columnists?

    I'd appreciate any answers you can give me on this since you obviously are better informed and care about this topic.
