Deadspin posts the Favre pics. Ugh.

    There's a whole generation of young people who seem pretty comfortable sexting and sending dick shots and randomly "hooking up." Not just athletes.

    I asked a few pages back and no one answered, I'll ask again, because I'm really curious:

    If this is in no way, shape or form Favre's voice or dick that have been sent and saved, doesn't he immediately have a legitimate law suit against Sterger or Deadspin or both?

    And, again, if this is in no way, shape or form Favre's voice or dick that have been sent and saved, why doesn't he come out swinging by threatening a law suit?

    A few reasons:

    Brett Favre is undeniably a public figure. In order for a public figure to prevail in a libel lawsuit, they need to prove actual malice. It isn't enough to prove that it wasn't Favre's voice and junk. You need to show that Daulerio knew or should have known it wasn't Favre's voice and junk and went ahead with it anyways.

    And if he did sue, the depositions would be hell for him. Imagine the fishing expedition the defense lawyer could have.

    "Have you ever had sexual relations outside of marriage? You have? Who were these women? Does your wife know about these incidents?"
    "Have you ever taken a photo of your genitalia? Please produce those photos."
    "Have you ever sent one of those photos to a woman other than your wife?"
    "We are filing a motion to have you submit to an examination of your penis by a photography expert"
    "Have you ever contracted a sexually transmitted disease?"

    Is this new information? I haven't seen anywhere that Daulerio acknowledged the possibility the VMs and picture weren't Favre.

    Reese has said his client "did not provide Deadspin with any information." And a Deadspin editor said it paid a third party for the material and acknowledged it's possible the man who sent the voice mails and photos may not be Favre.

    Seems to open up a wide range of theories and plausible denials on Brett's part. Just as a hypothetical -- he has a brother and some cousins who are basically trailer trash hanger-ons, right? Could one of them have used his phone, or could he at least say one of them used his phone?

    EDIT: That ital is from ESPN.com story.
