DOMA unconstitutional (5-4); Court punts on gay marriage (no standing)

    Of course not. My comment wasn't intended as a personal attack on anyone and I'm sorry if it seemed that way. A number of threads have got me feeling like there was zero chance of any genuine discussion if people are attacked for saying anything halfway honest.

    Props to the Ninth Circuit for immediately lifting the stay of the order. Wonder where the next appeal will come from that will force the states to recognize other marriages and eventually when the order will come down that all states have to honor gay marriages. I predict it will happen inside of five years.

    I think eventually we will get to the point of gay marriages being recognized legally in all 50 states, but I wouldn't be surprised if it continues as it has, one state at a time. I just don't see that happening so quickly.

    It's actually not the slam dunk Constitutional winner that a lot of liberals seem to think it is, and I think it's going to be a long time before it's recognized nationally, particularly before it's recognized by the Supreme Court as an Equal Protection right under the Constitution.

    Keep in mind that the following groups don't have equal protection rights, at least not in any practical sense as we'd understand them:

    * Elderly.
    * Young.
    * Disabled.
    * Poor.

    The following groups do:

    * Racial groups.
    * Genders.

    What in the world would make anyone think that the Supreme Court is going to add sexual orientation to a pretty short list of groups that receive heightened protection? I actually feel kind of bad for Scalia and the conservatives here, because in order to maintain intellectual consistency with their interpretation of the Constitution, there's no way they can add gays to that short list. But because they would never do so, they get painted as bigots. (Not that Scalia's out marching in pride parades in his spare time or anything.)

    So the only burden on traditional marriage advocates is that there is a rational basis, not related to religion or morality, for barring same-sex marriage. They're having a damned hard time articulating one at this point. I think that's largely behind the Court's decision to slow play this - what Kennedy is afraid of, and it's not a crazy fear, is that years after this, some research is going to come out that the children of same-sex couples are fucked up in some crazy way that we don't know about yet.
