Duke Lacrosse - All charges dropped

    The immunity priviledge for public officials isn't absolute. If they did something outside the bounds of their normal duties or they did not follow accepted practices for their type of job and it caused someone damage, then they can be opened up for liability.

    I don't see how the families don't sue. They're more than likely pretty well off and can afford it, especially if they shake down Duke to help with the cost. And if Duke doesn't help, they should sue the school too.

    But he may be disbarred, which seems appropriate considering how he handled this whole thing. I think his hearing is coming up soon.

    And the players aren't getting an apology from anyone. But what is Jesse doing with that tuition money. Maybe he's looking for another baby momma.

    Doubtful any of the players get any money out of this either. Not that they need it. Their names will always be associated with this, and there is no amount of money to take that away.

    It's possible that Nilfong can be civilly prosecuted for a Civil Rights violation, section 1983, by the family, for Nilfong's actions if they can prove race had a motive in his attempt to maliciously prosecute.

    At the very least, Nifong should be disbarred.

  10. Right now, these guys are the Unjustly Accused, the Vindicated. That's as good as it going to get for them. Nifong's gone, most likely, and the legal and political establishment of NC -- including the AG --- helped push him out the door. If they sue, they will open themselves and the culture of that house up to discovery, and their haloes will get dinged up in the process, and they will force the political and legal establishment of the state to defend itself against them. I'm not saying there might not be a quiet little settlement, but a full-blown civil trial? I doubt it very severely.

    And what of the alleged victim, Mary Magdalene? What will become of her? And her culture of the expressive arts? Her dance and oral skills?
