    I can't do that. I can't just shrug and say, "Hey, laws don't always make sense." If someone challenged a prostitution statute in court (maybe someone has) on constitutionality grounds, he/she would seemingly have to distinguish from Roe v. Wade. And he/she couldn't just argue, "What can I tell you, Judge? People are inconsistent!"

    People do it all the time. How do two different courts come up with entirely different conclusions on a law? How could Roberts and Scalia disagree on gay marriage? Emotions. (I agree with Roberts, FWIW.)

    You're a seasoned vet of our legal system. You already know it makes no real sense - that if, tomorrow, every criminal defendant decided, fuck it, I'm not gonna plea, the system would grind to a halt and criminals would walk free. it's about to happen to prison overcrowding. (It already is.)

    Relational reality thus, can be legal reality.

    I've long thought the Roe v. Wade thing was mostly a reaction to the plight of women.
