Ferguson / Staten Island Decisions -- No Indictments

    Coroner did rule homicide according CNN. Video captures it pretty well, too. I have no idea what the justification is for not indicting an officer who employed a chokehold - which is not allowed by the NYPD - to take down a non-violent suspect and kill him. It's really unbelievable the power we're giving police to act as executioner.

    Even if this isn't murder, how is this not at least manslaughter or negligent homicide?

    homicide is not a crime. murder is a crime. Coroner doesnt decide whats a crime only the cause of death. Homicide is the killing of one human by another, without regard to whether it was a criminal act

    So this year so far in NYS court system, Tony Stewart runs down a fellow racer with his car and does not get indicted and now a cop chokes the life out of a law abiding father of 6 that is caught on video and does not get indicted.

    I think it's safe to say that ham sandwiches have no worry in NYS.

    The cop broke the NYPD rule. But would it be considered a violation of the law if the cop was doing his duty, just with an illegal hold?

    What also is lost in all the Garner stuff is that he was resisting arrest at the time.

    As we have learned from the Ferguson legal experts, resisting arrest should have
    no baring on a Grand Jury decision.
