It seems Deadspin is about to go guns blazing at ESPN re: sex rumors

    Yup. Complete failure. Though they did update the last story with a name. Still, nothing close to what was promised, which I am happy to see.

    Deadspin/Gawker is counting on truth being an absolute defense. And let say you are one of the people Deadspin names and the incident in question is untrue. It is still likely that you have done some things at work that you are not proud of. Do you want to give a deposition where lawyers go on a virtually unlimited fishing expedition into your life, knowing that DS/Gawker editors will get to read it? Simpler just to say "it's untrue, look at the source" and move on.

    Seeing this post earlier today got me to read all that stuff, as tawdry as it was.

    I think it's fair to say Steve Phillips needs some serious counseling.

    Aside from defamation, there are other potential privacy torts such as public disclosure of private facts. That's more likely for the off-air employees as the type of plaintiff (public figure, etc.) also is important in that line.
