Jameis Winston in trouble? (This time for stealing crab legs?)

    Yeah, DNA just means sexual contact, not necessarily a lack of consent. If her statement was the only thing indicating lack of consent and the cops doubted it, then they did the right thing in holding back. The whole thing is a mess. I still wonder if this is a case of regret rounded up to rape.

    Sometimes, rape kits will get a positive ID on the person who had sex with the victim, but also show a total lack of the hallmarks of assaultive sex (vaginal lacerations and such), so they'll wind up being more exculpatory than not.

    I still wonder about the police conduct, though. After a year, a rape case is basically a cold case. Maybe they did more investigating and haven't disclosed the details, but typically, when pressed by the media, police will provide more detail to show they haven't been sitting around with their thumbs up their asses. They haven't done that here.

    In the absence of a definitive answer, I'm betting most Heisman voters are not going to want to cast a vote that has the potential to embarrass them on a national scale. Who's going to send in the "yeah he might end up being a convicted rapist, but damn good football player" column?

    For whatever reason ranging from completely nefarious to simply judging that this was consensual sex (i.e., not believing the complainant), the case went cold because the initial report shelved it. It's not like there were no other crimes in Tallahassee at that point.

    So, recapping, based on what's been reported -

    1. Winston had physical contact with the victim.

    2. The victim wasn't intoxicated.

    3. The Tallahassee Police Department is a clown show.

    That about sum it up?

    One lickety-split way to get kicked out of a jury pool is to say you give a cop's word more credence than any other witness.

    Hey oh by the way not that anyone at FSU is worried or anything, but it turns out that whole felony/automatic suspension thing isn't so automatic after all. It can be waived based on "extraordinary circumstances as determined by the administration."

    The state's attorney is screwed either way. If he doesn't prosecute, he's part of the cover-up. If he does, he's taking a case that's so messed up he's very unlikely to win, with horrible career consequences for losing.

    Yup. I'd say his best -- and only -- course of action is to blame the detectives for supposedly never passing along the evidence/interviews, etc. You're not winning this case at this point.
