    Is this one of those things where if you're picketing in a Capitol building and you see other people smashing windows and assaulting cops, you either walk away or you're complicit?

    It's like marching in Charlottesville to protect statues, hearing the guys say "The Jews will not replace us!" and continuing on, happy to have common ground (the statues) with literal Nazis.

    I don't know criminal law well enough to really say. But I'd find a law that makes anyone complicit for something they personally haven't done, wrong. Not that this guy may not have been sympathetic to the others acting violently, but at the end of the day, legally he should only have to answer for what he personally has done. Plus, even if the standard was somehow what he saw going on around him. ... how do you know (or prove) what he personally saw?

    I assume they hit these clowns with the most serious charges they could make stick. ... unless they get a plea, in which case they may take it down a notch.

    Dipshits now begging for the courts to bail them out.

    Arkansas Gov. Asa Hutchinson said he now regrets signing a law banning mask mandates.
    "In hindsight, I wish that had not become law,” said Hutchinson in a press conference on Tuesday.
    "But it is the law," the Republican governor continued. "So the only chance we have is to amend it or for the courts to say it has an unconstitutional foundation."
    And the governor acknowledged that was a possibly deadly mistake.
    "I signed it at the time because our cases were at a very low point," said Hutchinson. "Everything has changed now."


    Well, golly gee, if only there was a more forward-thinking option than conservatism.

    An interesting distinction I didn't know until The Big Ragu bought up the question of levels of involvement. A federal misdemeanor is still serious. I found this on one website that specializes in federal criminal defense.

    "A federal misdemeanor conviction WILL NEVER BE EXPUNGED which brings us to the subject of this section – pretrial diversion programs. Pretrial diversion programs are a special kind of plea bargain that allows you ultimately to avoid a permanent conviction. Federal prosecutors are much more willing to consider them in misdemeanor cases than felonies."

    Holy crap. That's not a good thing to find on your rap sheet.

    I think that almost all of the charged entered the Capitol building. If they have proof they destroyed stuff, stole, did more then just go inside they got felony charges, as did anyone they had info showing they helped organize it. The little fish have mostly gotten off with misdemeanors.
