That doesn't matter. The harm was the defamatory statement and that's what triggers the statute of limitations. They could've sued within the window of the statute of limitations and then used discovery to root out evidence of actual malice. As long as they alleged actual malice in the pleadings, which shouldn't be hard to do with the National Enquirer, the lawsuit should survive to discovery.

Trump claims to hate the media. And yet....The media touted his "accomplishments" in the tabloid NYC culture of the 80s. The media promoted him as a genuine business titan on the Apprentice. The media praised and defended him at every turn for his superannuated couch potato base. And the media hid damaging news for him...and did fake hit pieces on his enemies.

I'm certain any "ideological shortcomings" could be assuaged by a high six figure donation to Trump Inc. Trump really should be asked repeatedly who he will staff his administration with considering how many of his first termers quit, were fired, were jailed (and pardoned - or not) or are facing additional legal issues. The House and Senate would be wise to put a three-month limit on "acting" secretaries and the like to avoid doing what he did last time, in order to avoid Congressional approval.

 

If you asked anyone in 2002 if Trump or Macaulay Culkin would be president in 15 years....most would gone have gone with Mac.
