It could be argued that his explicit refusal to divest his properties prior to inauguration indicated his active intention to violate the emoluments clause, and thus rendered him legally ineligible to take office in the first place.

I agree. I just think if you dislike what the guy does around here, and I'm among those who feels that way, the very best think to do is stop speaking about him entirely and focus on the topic. It's the best thing for the discussion here and more importantly, it will make him nuts.
