    It can lead into problems if your actions prior or coincidental to the incident in question demonstrate you did have knowledge.

    If it is connection with a deposition (or a trial) you look like an idiot and not worthy of belief, especially if you later remember the facts in question or if you have a good memory of something which helps you.

    If you are a person speaking with regulators you may lose your job as they (or your employer) may not deem your lack of memory to be credible (as the standard of proof is not beyond a reasonable doubt the way that it is with a criminal conviction). Or if you are a politician, the voters may care.

    But if your sole purpose is to avoid a perjury conviction, other consequences be damned, then it is a tactic.

    I took the deposition many years ago of a CEO of a public company. He answered every substantive question with “I don’t presently have a recollection of that”. I hammered him pretty good, showing him document after document exactly on point, including his own notes and emails, which were meant to jar his allegedly faulty memory. Quite simply, I thought that I made him look silly that he claims that he dd not remember anything. But he wouldn’t budge.

    He thought that it the matter went to trial, he would miraculously regain his memory and say that I didn’t show him the right documents or ask the right questions. Unfortunately we settled before trial.

    I agree with Brian Williams - the Mueller Report needed a writer.
    The end product itself not capturing the public is where it failed.
