    Why LOL? Not everyone has become the Supreme Justice that everyone thought they would become; just recently Powell, Souter, Kennedy, White. In fact, to me that's when the system has worked, when the intellect and respect for the institution outweighs the political agenda.

    As for Ms. Davis, why not a federal public defender? IMHO, they are just as likely to be a bright jurist as someone from the prosecutor's office or the big firm. I'm not going to see many others appointed in my lifetime and I just want there to be the brightest at the biggest court in our land (not lesser talents who fit some litmus test (Thomas)).

    Look, she may be brilliant.

    But, a public defender is pretty likely to be fairly liberal. And, it's about as far afield from a sitting Republican governor.

    I guess it won't matter much. McConnell's going to keep the cork in until Hillary gets her pick.

    They're liable to wish that they had talked to Obama.

    If she's qualified, that's all the criteria that the Senate is supposed to use for its consent per the Constitution. The only one that has really been blocked for a litmus test is Bork and in my eyes, he was qualified.

    I agree that they should use only that as their criteria, but like the baseball Hall of Fame, the Constitution doesn't spell out how they should decide whether to consent to a nominee.

    I didn't think he was. I thought he was just testing the GOP the day after they said they weren't going to hold hearings on anyone.
