Still think Texas has never executed anyone who was innocent?

    No, you are wrong.

    And where the fuck do you get off trying to tell people where they can or cannot stand?

    I am for the idea of the death penalty 100 percent - I'm just not for it the way that it is administered in this country at this point in time because of some of the obvious flaws in the system and the corruption/incompetence of some of the people who run the system.

    But it is something we definitely need to continue to try and perfect because there are a whole lot of people who have given up their right to be alive.

    It is a lot like abortion - you don't have to be for abortion to support the legal right to an abortion.

    The actual act of abortion turns my stomach and in my mind is basically murder and I wish people would be more responsible with their choices - but I also understand the pragmatism involved in allowing abortion in a very limited capacity and thus it is necessary to remain legal.

    WTF? So you're saying that the statement "I support the death penalty if it is deserved" is somehow logically flawed?

    Why not? We already have different standards of evidence for different types of trials. You could add another.

    You'd go pretty far by shifting the burden of proof away from the defendant even on appeal (either to the prosecution again, or starting even). Also, allow the appellate judges to consider items settled below in a case where they see clear error - even setting aside a jury's conclusion on questions of fact. And impose a standard on sentencing higher than reasonable doubt.

    (Don't know if any of this is realistic - not my area.)

    So you agree with Rick - that we shouldn't punish criminals severely, that we should make excuses for them and coddle them?

    Deserved is a relative term.

    Death penalty is warrented with a combination of the following DNA, fingerprint, eyewitness and video evidence. Make it more concrete.

    And even DNA is flawed. Remember the FBI lady a few years ago who was giving positive replies to police because she wanted to help them?

    No, not really.

    I have no question in my mind that the idiot who was convicted of shooting up the Long Island railroad, actually did it.

    As for killing everyone in prison - I have a better answer, let them do it themselves.

    Like for instance, get the courtyard completely sealed off so there is no escape. Get all of the guards armed with rifles and at the top in the towers looking down so none are in harms way.

    Then let all of the members of the black gangs, Mexican gangs and Aryan gangs into the courtyard on a hot sunny day and let them beat the fuck out of each other until only one is standing - then shoot his ass for committing violent crimes while incarcerated......
