    The woman was eventually driven to the hospital by friends, and an emergency room doctor and two nurses examined her. Bright said they noted a superficial laceration, bruising and slight bleeding in her genital area, but that everything else was normal and that the doctor could not say definitively that the bruising was from any kind of trauma or sexual assault. The doctor and nurses collected a standard rape evidence kit. Initial testing found human male DNA present, although the emergency room doctor found no evidence of semen. Further testing was done, but Bright said that because the sample was so small, a DNA profile could not be obtained.

    “Every case must be viewed in the context of its circumstances,” Bright said. “Here, the overall circumstances do not lead to a viable prosecution. We are not condoning Mr. Roethlisberger’s actions that night. We do not prosecute morals. We prosecute crimes.”

    That's some lame lawyering by the DA. He could have done better than that. The only thing I read that makes this believable is that the accuser and her parents apparently did not want to press charges.

    No evidence of forcible penetration. No DNA evidence. No cooperation from the alleged victim. That's three strikes against any rape case.

    So they are basically saying that he is a dirtbag, but not a criminal. I still wonder a bit, but that does seem likely at this point.

    I don't think there's a jury in America that wouldn't convict him of douchebaggery.

    Yes there's no DNA, but you have this woman's version. The problem is the DA knocks her story because its slightly different when she's sober vs. when she's visibly intoxicated. Well, duh? You think? Here's a woman who just had sex after she was obviously intoxicated. What is consistent is she said from the start she wanted to leave the stall, but was prevented. Big Ben has not said anything so her version is uncontradicted. Yet, the DA just drops it. I bet if you dig deeper (read the witness statements; physician statements), its not as neat and tidy as the DA presented today.

    So even though Ben's never been charged with anything, he's going to have a wingman with him at all times and probably will only now date women he meets through other people. Because you've go to know he'd be a prime target for someone looking for a payday, even if nothing happens. I wonder if past flings have contacted him for money to stay stay quiet.

    They didn't have enough to go to trial. Given that, because this is a high-profile case, the DA has to sell not charging him to cover his own ass.
